Conditions of Use and Disclaimers for the Use of Government Wi-Fi Services
Please read the following conditions of use and disclaimers ("the Conditions") carefully before using the wireless Internet access service ("this Service") provided by the Government of the Hong Kong Special Administrative Region ("the Government") at designated venues ("Locations"). By using this Service, you agree to accept unconditionally the Conditions which may be revised and/or amended from time to time by the Government without prior notice to you. If you do not accept the Conditions, you must immediately close the browser and the connection and neither make nor permit use of this Service thereafter.
- Each User shall comply with all applicable laws and regulations of the Hong Kong Special Administrative Region.
- Each User shall have a Wi-Fi enabled device and related software in order to use this Service. The Government does not guarantee that the Service will be compatible with User's device and related software. The Government is under no obligation to provide technical support for User's Wi-Fi enabled devices, including but not limited to their Wi-Fi connection functionality. The Government does not accept any liability for any loss or damage to User's Wi-Fi enabled device and related software arising out of or resulting from the use or attempted use of this Service.
- Each User shall NOT use this Service for accessing web pages containing obscene, indecent or illegal materials, or engaging in illegal gambling or other illegal acts.
- Each User shall NOT use this Service for any unauthorised uploading or downloading or for any infringement of Intellectual Property Rights of any parties. Any infringement of Intellectual Property Rights may incur civil and criminal liabilities. For more information on the protection of the Intellectual Property Rights, please refer to the homepage of the Intellectual Property Department.
- If any unauthorised uploading or downloading or any infringement of Intellectual Property Rights by any User is detected or known, the Government may take such actions as it considers appropriate against the User including without limitation referring the case to the relevant bodies or authorities for their investigation or action and stopping the User from using this Service.
- Each User shall be liable for and shall fully indemnify the Government against all claims, actions, proceedings, liabilities, demands, damages, losses, expenses or costs arising out of or resulting from his/her prohibited or illegal acts, unauthorised uploading or downloading, infringement of Intellectual Property Rights of any party, use of this Service and/or breach of the Conditions.
- Each User shall NOT cause inconvenience or annoyance to other persons when using this Service. The Government shall have the power to stop the User from using this Service if any such inconvenience or annoyance is reported or known.
- Each User acknowledges and agrees that the Government shall have the power and full discretion to disallow any person from using this Service whenever the Government considers appropriate.
- Each User acknowledges and agrees that the Government will keep logs of activities on the Internet and browsing history of User. The logs will be used by the Government for service maintenance and compilation of usage statistics. Any information contained in the logs will not be disclosed to any unauthorised person, unless the disclosure is required by law, regulation or court order, or is necessary for law enforcement or preventing or stopping illegal activities or contravention of the Conditions. The Government will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction, or damage (including without limitation direct or indirect, special or consequential loss, destruction or damage) howsoever arising from or in respect of the disclosure.
- Each User acknowledges and agrees that he/she use this Service at his/her own risk. Each User should note that there are risks in using this Service, including without limitation the information security, transmission interruption, delay or failure, and computer virus or malware contraction. The Government does not guarantee the security of any data transmission using this Service. The Government will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction, or damage (including without limitation direct or indirect, special or consequential loss, destruction or damage) howsoever arising from or in respect of any use or misuse of this Service.
- This Service is provided to each User on an "as-is" basis without expressed or implied warranties or representations of any kind. The Government does not guarantee the performance, speed, stability and availability of this Service. The actual performance will depend on the number of concurrent users, the signal strength at the spot where the User is located, and other factors affecting the Service. Each User acknowledges that this Service is not intended for supporting any use which requires fault free or uninterrupted data traffic flow. The Government will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction, or damage (including without limitation direct or indirect, special or consequential loss, destruction or damage) suffered by any User and howsoever arising from or in respect of the Service including but not limited to its performance, speed, availability and stability.
- Each User acknowledges and agrees that he/she carries out any downloading or uploading through using this Service at his/her own risk. The Government will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction, or damage (including without limitation direct or indirect, special or consequential loss, destruction or damage) howsoever arising from or in respect of any downloading or uploading through using or misusing this Service.
- Each User acknowledges and agrees that he/she accesses external websites delivered on or via this portal at his/her own risk. To facilitate access by a User to information provided by or via other parties, this portal may provide or assist in providing links to external websites through its pages. Provision of, or assistance in providing, these links gives rise to no statement, representation or warranty, express or implied, that the Government agrees or does not disagree with the contents of any such external sites and the Government will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction, or damage (including without limitation direct or indirect, special or consequential loss, destruction or damage) howsoever arising from or in respect of any use or misuse of or reliance on the contents of any such external websites delivered on or via this portal.
- The Conditions shall be governed by and construed in accordance with the Laws of Hong Kong Special Administrative Region. Each User agrees to submit to the exclusive jurisdiction of the courts of Hong Kong Special Administrative Region.
In the Conditions set out above, the following words and expressions shall have the following respective meanings:
- "Intellectual Property Rights" means patents, trade marks, service marks, trade names, design rights, copyright, domain names, database rights, rights in know-how, new inventions, designs or processes and other intellectual property rights of whatsoever nature and wheresoever arising, whether now known or hereafter created, and in each case whether registered or unregistered and including applications for the grant of any such rights.
- "User" means any person using this Service at Locations.
Note : If there is any conflict or inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.
香港政府Wi-Fi無線上網服務之使用守則及免責聲明
在使用由香港特別行政區政府（“政府”）在指定場地（“場地”）提供的無線上網服務（“本服務”）前，請細心閱覽以下使用守則及免責聲明（“本守則”）。你使用本服務，即表示你同意無條件接受本守則，以及政府不時在沒有預先通知的情況下對本守則作出的修改及/或修訂。如不同意本守則，請立即關閉瀏覽器、結束連線及停止繼續使用本服務。
- 使用者須遵守香港特別行政區的所有適用法律及規例。
- 使用者須配備支援Wi-Fi的無線裝置及相關軟件才能使用本服務。政府並不保證本服務可與使用者的裝置和相關軟件兼容。政府沒有責任為用戶的Wi-Fi裝置提供技術支援，包括但不限於其Wi-Fi裝置的連接功能。政府不會承擔任何因使用或嘗試使用本服務而引起或導致使用者的Wi-Fi裝置及相關軟件的任何損失或損害。
- 使用者不得利用本服務瀏覽或存取含有淫褻、不雅或非法內容的網頁，亦不得利用本服務參與非法賭博或其他非法活動。
- 使用者不得利用本服務進行未經許可上下載或作出任何侵犯知識產權的行為。如有任何侵犯知識產權的行為，可能會負上民事和刑事責任。有關保護知識產權的詳盡資料，可參閱知識產權署的網頁。
- 如發現或知悉使用者進行未經許可上下載或作出任何侵犯知識產權的行為，政府可採取其認為適當的行動，包括但不限於把個案轉交有關機構或當局調查或採取行動，以及終止該使用者使用本服務。
- 如使用者作出違禁或非法行為、未經許可上下載或作出任何侵犯任何一方的知識產權的行為、使用本服務及/或違反本守則，使用者必須對因此引起或導致的所有索償、訴訟、法律程序、法律責任、要求、損害、損失、支出或費用負上法律責任，以及對政府作出所有彌償。
- 在使用本服務時，使用者不得對他人造成不便或滋擾。如接獲有關投訴或知悉上述行為，政府有權停止使用者使用本服務。
- 使用者明白及同意，如有需要，政府有權及可全權決定停止任何人士使用本服務。
- 使用者明白及同意，政府會保留使用者瀏覽互聯網的活動記錄。使用者的瀏覽記錄會用於維修服務和統計用量。除了因應法律、規例或法庭命令的要求、執法需要或為了防止或制止非法活動和違反本守則的行為外，任何記錄內的資料將不會披露予任何未經授權的人士。對任何因披露記錄資料而導致任何損失、破壞或損害（包括但不限於直接、間接、特別或隨後的損失、破壞或損害），政府不會承擔或接受任何法律責任、義務或責任。
- 使用者明白及同意，使用本服務，須自行承擔風險。使用者應留意使用本服務的風險，包括但不限於資訊保安風險、資料傳送受阻、延誤或故障，以及電腦病毒或惡意軟體感染。政府並不保證使用本服務時資料的安全傳送。如因本服務、使用或不當使用本服務而導致任何損失、破壞或損害（包括但不限於直接、間接、特別或隨後的損失、破壞或損害），政府不會承擔或接受任何法律責任、義務或責任。
- 本服務以“現況”形式提供予使用者，並無任何種類的明示或暗示的保證或陳述。政府並不保證本服務的表現、速度、穩定性和可用性。服務的實際表現視乎同時使用服務的使用者數目、使用者所處位置的訊號強弱及其他可能影響服務的因素。使用者明白，本服務並不支援要求使用上不會發生故障或不間斷地傳輸數據的用途。如因本服務，包括但不限於其表現、速度、可用性和穩定性而導致使用者蒙受任何損失、破壞或損害（包括但不限於直接、間接、特別或隨後的損失、破壞或損害），政府不會承擔或接受任何法律責任、義務或責任。

- 本守則受香港特別行政區法律管限，並按香港特別行政區法律解釋。使用者同意接受香港特別行政區法院的專屬管轄權。

- “知識產權”指專利、商標、服務商標、商用名稱、設計權、版權、互聯網域名、數據庫權利、知識、新發明、設計工序或方法的權利，以及其他知識產權；不論其性質、在何處產生、屬已知或其後產生，或有關知識產權是否已經註冊及包括要求獲授任何有關權利的申請。
- “使用者”指在場地內使用本服務的任何人士。
